Welcome to BrowseBuy (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of the BrowseBuy website, services, and mobile applications (collectively, the “Service”), as well as the consignment, sale, and purchase of pre-loved clothing and accessories through our platform.
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
1. Account Registration
1.1 Account Creation
To use certain features of our Service, you may need to create an account. When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
1.2 Account Eligibility
You must be at least 18 years old to create an account and use our Service. By creating an account, you represent and warrant that you are at least 18 years old.
1.3 Account Security
You are responsible for maintaining the security of your account and password. BrowseBuy cannot and will not be liable for any loss or damage resulting from your failure to comply with this security obligation.
2. Consignment Services
2.1 Consignment Agreement
When you consign items with BrowseBuy, you enter into a consignment agreement with us. You authorize BrowseBuy to act as your agent in selling your items on your behalf.
2.2 Item Eligibility
BrowseBuy reserves the right to determine which items are eligible for consignment. We accept items that meet our quality standards, including:
•Clean and in excellent condition
•Current styles (within last 3 years)
•Quality brands and materials
•Sizes 6-22 for ladies’ clothing
•Age 0-24 months for baby clothing
Items with stains, holes, pilling, odors, or significant wear may be rejected. Fast fashion brands (e.g., Shein, Temu) and very low-value brands are not accepted.
2.3 Consignment Period
Your items will be listed for a consignment period of 90 days from the date of listing. If items remain unsold after this period, you may choose to:
•Have them returned to you (handling fee may apply)
•Donate them to our charity partners
•Continue listing them at a reduced price
2.4 Consignment Earnings
You will receive 60% of the sale price for each item sold. Payments are processed on the 1st and 15th of each month via EFT to your bank account.
2.5 Ownership and Authority to Sell
By consigning items with BrowseBuy, you represent and warrant that:
•You are the legal owner of the items
•The items are authentic and not counterfeit
•You have the right to consign and sell the items
•The items are free from liens or encumbrances
2.6 Item Pricing
BrowseBuy has sole discretion in determining the listing price of consigned items. We research current market rates for pre-loved items of similar brand, condition, and style to ensure competitive pricing that maximizes your earnings.
2.7 Item Condition
You agree to provide items that are clean and in the condition described during the intake process. BrowseBuy reserves the right to reject items that do not meet our quality standards upon inspection.
3. Purchasing from BrowseBuy
3.1 Item Descriptions
While we strive to provide accurate descriptions and photographs of all items, we cannot guarantee that the colors, textures, or details will appear exactly as they do in person. All items are pre-owned unless explicitly stated otherwise.
3.2 Pricing and Payment
All prices are listed in South African Rand (ZAR) and are subject to change without notice. Payment must be made in full at the time of purchase through our secure payment methods.
3.3 Order Acceptance
Your order constitutes an offer to purchase. BrowseBuy reserves the right to accept or decline your order at our sole discretion.
3.4 Shipping and Delivery
BrowseBuy will arrange for the delivery of purchased items to the address provided by the buyer. Delivery times are estimates and not guaranteed. Risk of loss and title for items pass to you upon delivery.
3.5 Returns and Refunds

4. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
•Using the Service for any illegal purpose
•Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service
•Uploading invalid data, viruses, worms, or other software agents through the Service
•Collecting or harvesting any personally identifiable information from the Service
•Impersonating another person or otherwise misrepresenting your affiliation with a person or entity
•Interfering with the proper working of the Service
•Bypassing the measures we may use to prevent or restrict access to the Service
5. Intellectual Property
5.1 BrowseBuy Content
The Service and its original content, features, and functionality are owned by BrowseBuy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
5.2 User Content
By submitting content to BrowseBuy (including photographs of consigned items), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your content in any existing or future media.
6. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.
7. Limitation of Liability
To the maximum extent permitted by law, BrowseBuy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
•Your use or inability to use the Service
•Any unauthorized access to or use of our servers and/or any personal information stored therein
•Any interruption or cessation of transmission to or from the Service
•Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party
8. Indemnification
You agree to defend, indemnify, and hold harmless BrowseBuy and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from:
•Your use of and access to the Service
•Your violation of any term of these Terms
•Your violation of any third-party right, including without limitation any copyright, property, or privacy right
•Any claim that your content caused damage to a third party
9. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
10. Governing Law
These Terms shall be governed by and defined following the laws of South Africa. BrowseBuy and yourself irrevocably consent that the courts of South Africa shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Terms.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
